Dynamic-Mails Terms Of Service

By signing up and actively using the Dynamic-Mails program you agree to all terms and conditions set forth in this agreement. Dynamic-Mails may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its affiliates. Affiliates will be informed of any and all changes to this policy via an e-mail to their primary contact e-mail address provided upon signing up with Dynamic-Mails. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the Dynamic-Mails program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.

Responsibility of Affiliates:

You must be 13 years of age or older to participate in this program. As of 08/01/2009 we are back to Tier 1+2 countries only and is void where prohibited by local governing laws.
Current members from all other countries could stay and they can redeem for ads only as long as they are honest.

Tier 1+2 countries are:
Australia, Austria, Belgium, Canada, Denmark, Finland, France, Germany, Greece, Iceland, Italy, Netherlands, New-Zealand, Norway, Portugal, Spain, Sweden, Switzerland, United Kingdom and United States

You agree to and must use your own name and e-mail address in the sign-up process and may not assume a false identity. You may not sign-up multiple times with different e-mail addresses. Your computer must not be shared with another individual that has an existing Dynamic-Mails account.

You will use your e-mail address / password combination to access your account, it is your responsibility to keep this information confidential, you may change this information by logging into your account and following the "User Account Info." link.
You are solely responsible for any and all use of your Dynamic-Mails account including authorization by you to any third party individual who may use your account.

Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by Dynamic-Mails be detected it may result in member termination and possible legal action. Any solicitation of advertisers for a confirmation e-mail for purposes of receiving credit in your account will be grounds for immediate termination.

You must maintain your e-mail account that you used when signing up with Dynamic-Mails. You agree to receive e-mail advertising from Dynamic-Mails.

In the event your e-mail account on file becomes closed or blocked to messages from Dynamic-Mails, your account will be terminated. This especially applies to e-mail accounts returned for being Full. Any member sending us gibberish will result in automatic termination of account and Forfeiture of All earnings to date of termination. Auto-responses will also be deleted immediately.

Sister sites of Dynamic-Mails

Dynamic-Mails does have 2 Sister Sites: Area-51-Emails & JointVentureEmails (all sites .com) and as long as that will be the case it is not allowed to advertise the Sister Sites at Dynamic-mails and v.v.

Click Activity Requirement & Self-Earnings:

Members who are making use of the upgraded ptp link and/or do have an affiliate page:
- self-earnings 20% of their total earnings in their account earned by clicking PTC / emails.
- you must login at least every month and click/read 100 PTC / Emails per month.

Members who are making use of the free ptp link and/or do have an affiliate page:
- self-earnings 10% of their total earnings in their account earned by clicking PTC / emails.
- you must login at least every month and click/read 75 PTC / Emails per month.

Members with the free "De Koker" upgrade and/or do have an affiliate page:
- self-earnings 5% of their total earnings in their account earned by clicking PTC / emails.
- you must login at least every month and click/read 50 PTC / Emails per month.

Members who don't make use of the PTP and don't have an affiliate page or any upgrade:
- you must login at least every month and click/read 1 PTC / Emails per month.

Just logging in doesn't make you an active member.

Vacation Mode

You are allowed to put your account on vacation mode twice a year for a period of 3 weeks without informing the admin.
It is not allowed to put your account on vacation mode one month behind the other.
When you will be on vacation for a longer period, you need to contact the admin and ask for permission.

PTP Feature & Affiliate Pages

You may only promote either the "Free" OR "Upgraded" PTP link (if you are a paid upgraded member)..... you may NOT promote both. All members are allowed to make use of the free ptp link. When you are caught to abuse the PTP, your earnings will be lost and your account will be suspended. This will not be withdrawn.

You may not promote your affiliate page at sites mentioned in our banlist. Dynamic-Mails do have the right to add a site to the banlist at any time.
When you are caught promoting your affiliate page at a site mentioned in our banlist:
1st & 2nd time - you will receive a message with the request to remove the promoting at that site within 2 days.
3rd time - you will receive a message that your affiliate page has been removed and will not be withdrawn.

Relationship of the Parties:

You and Dynamic-Mails are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and Dynamic-Mails. You understand that you do not have authority to make or accept any offers or make any representations on behalf of Dynamic-Mails. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the program.

Limitation of Liability:

Dynamic-Mails will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or Dynamic-Mails program, even if Dynamic-Mails has been advised of the possibility of such damages. Furthermore, Dynamic-Mails aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement.

Payments:

Payment Requests:

Affiliates from Tier 1 & 2 can request for payout, all other affiliates can only redeem for ads.

Dynamic-Mails will pay affiliates when their balance reaches the minimum payout rate set by Dynamic-Mails ($1.00). Once the member has reached payout they may request payment.
Maximum payout is $5.00. Any request above $5.00 will be rejected. If this happens more than one time your account will be fined with $0.25 and when this continues you are only allowed to redeem your earnings for ads.
Members with Affiiliate Pages and members who make use of the PTP have to be a certain % of their total earnings in their account earned by clicking PTC and emails.See above under Click Activity Requirement & Self-Earnings.
It is not allowed to request payout by earnings from affiliate pages and PTP only.
Payments will be made within 60-90 days and you can request for a payout every 60 days.

Since 06/03/2009 PayPal is charging a fee that has to be paid by the receiver. This means the amount you receive will be lower than the amount you request.
No mass payments will be made anymore which means that members will be charged by Paypal for the costs (fee) involved in the payout. Those costs (fee) will be 3.4% + $0.47 (depending on country).

This part concerns for WM/PO only

When you own a site and are behind in payments:

1) You are not allowed to ask for payout
2) You are not allowed to redeem for ads in my sites and expect me to put them out
3) If you buy ads or upgrades at my sites I will consider it a site donation.

Behind in payments or not paying within the terms are you when you exceeded the 30 days.
When you informed your members about the delay in payments, you will have another 30 days to pay your members.
If you after the 60 days still didn't pay your members, your account will be canceled and your earnings considered as site donation.

Spam:

You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your affiliateship with Dynamic-Mails and may result in legal prosecution. Dynamic-Mails strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. Dynamic-Mails may charge up to $5 per spam e-mail sent. Multiple sign-ups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. Dynamic-Mails will file charges for recovery of any earnings received from multiple sign-ups.
